This policy explains what personal information we collect when you browse, contact us or place an order, why we collect it, who we share it with, and the rights you have — including the specific rights of California residents.

1. Who we are

SMILETIAN CLOTHING.LLC is a Florida Limited Liability Company with its principal place of business at 8610 N Sherman, Miramar, Florida 33025, United States. We are the business responsible for the personal information described in this policy.

2. What we collect

We collect the following categories of personal information:

  • Identifiers and contact details. Name, email address, phone number, billing and shipping address. Collected when you place an order, submit the contact form, or send us closet plan details.
  • Commercial information. Products you have viewed, added to your cart and ordered, order values, and any returns or refunds.
  • Internet activity. Pages viewed, referring page, approximate location derived from IP address, browser and device type. Used in aggregate to understand what is working on the site.
  • Enquiry content. Whatever you choose to tell us in a message, including descriptions of your wardrobe and garments.
  • Consent records. Which checkboxes you ticked, and when.

What we do not collect. We do not collect or store payment card numbers. Card details are entered on a secure encrypted payment page and handled by a PCI DSS Level 1 certified payment provider — they never reach our servers. We do not collect government identification numbers, health information, biometric data, precise geolocation, or the categories of sensitive personal information defined by the California Privacy Rights Act.

Your cart is stored in your own browser using local storage, not on our servers, until you submit your details at checkout.

3. Why we use it

  • To take, process, pack and ship your order, and to contact you about it.
  • To answer questions, including fabric and safety questions, and to prepare closet plan suggestions when you request one.
  • To process returns, refunds and warranty issues.
  • To meet our legal, tax and accounting obligations in the United States.
  • To detect and prevent fraud and abuse of the site.
  • To understand, in aggregate, how the site is used so we can improve it.
  • To send seasonal care reminders, but only if you have asked for them. These are free, are not a subscription, and every message includes a one-click unsubscribe.

4. Who we share it with

We share personal information only with service providers who need it to do a job for us, and only for that purpose. These currently include or will include:

  • Our payment provider, which processes your payment and handles card data directly.
  • Shipping carriers and fulfilment partners, which receive your name, address and phone number to make the delivery.
  • Our website host and database provider, which stores order and enquiry records.
  • Our email provider, which sends order confirmations and replies.
  • Professional advisers, and government or law enforcement bodies where we are legally required to disclose.

We do not sell personal information, and we do not share personal information for cross-context behavioural advertising. We do not disclose personal information to third parties for their own marketing purposes.

5. California residents — CCPA and CPRA

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you the following rights:

  • Right to know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties we disclose it to.
  • Right to delete personal information we hold about you, subject to exceptions such as completing a transaction or complying with a legal obligation.
  • Right to correct inaccurate personal information.
  • Right to opt out of sale or sharing. We do not sell or share personal information as those terms are defined, so there is nothing to opt out of. If that ever changes we will publish a “Do Not Sell or Share My Personal Information” link before it takes effect.
  • Right to limit the use of sensitive personal information. We do not collect sensitive personal information as defined by the CPRA.
  • Right to non-discrimination. We will not deny you goods, charge you a different price or give you a lower quality of service for exercising any of these rights.

How to make a request. Email support@smiletianclothing.shop with “Privacy request” in the subject line, or call +1 1419386957. We will confirm receipt within 10 business days and respond substantively within 45 days, which we may extend by a further 45 days where the request is complex — we will tell you if that happens. To protect you we will verify your identity, normally by matching the email address and order details you give us against our records. An authorised agent may make a request on your behalf with written permission.

In the preceding 12 months we have collected the categories of personal information listed in section 2, for the purposes listed in section 3, and disclosed them for a business purpose to the categories of recipients listed in section 4. We have not sold or shared personal information.

6. Other US state privacy laws

Residents of states including Virginia, Colorado, Connecticut, Utah, Texas, Oregon and Montana have comparable rights to access, correct, delete and obtain a portable copy of their personal information, and to opt out of targeted advertising, sale and certain profiling. We do not conduct targeted advertising, sell personal information, or carry out profiling that produces legal or similarly significant effects. To exercise any right, use the same contact route as in section 5. If we decline a request you may appeal by replying to our response; we will respond to an appeal within 60 days.

Visitors from the EEA and the UK. We sell to customers worldwide. Where the General Data Protection Regulation or the UK GDPR applies to our processing, our legal bases are performance of a contract (to fulfil your order), legitimate interests (to run and secure the site and respond to enquiries), consent (for seasonal reminder emails), and legal obligation (tax and accounting records). You have rights of access, rectification, erasure, restriction, portability and objection, and you may complain to your local supervisory authority. Personal information is processed in the United States.

7. Children — COPPA

This store is intended for adults. We do not knowingly collect personal information from children under 13, in line with the Children’s Online Privacy Protection Act. If you are between 13 and 17, please use this site only with the involvement of a parent or guardian, who must place any order. Several products we sell — steam appliances, sewing needles, household chemicals and moisture absorbers — require adult handling.

If you believe a child under 13 has given us personal information, contact us at support@smiletianclothing.shop and we will delete it promptly.

8. How long we keep it

  • Enquiries and closet plan requests: up to 24 months from your last contact with us.
  • Order and transaction records: as long as required for tax, accounting and warranty purposes, generally seven years.
  • Seasonal reminder list: until you unsubscribe.
  • Analytics: aggregate and non-identifying, retained indefinitely.

9. How we protect it

The site is served entirely over HTTPS with TLS encryption. Access to order and enquiry records is limited to people who need it to do their job. Payment card data is never stored on our systems — it is handled by a PCI DSS Level 1 certified payment provider on its own encrypted infrastructure. No method of transmission over the internet is completely secure, and we cannot guarantee absolute security; if a breach affects your personal information we will notify you as required by applicable law.

10. Cookies

We use a small number of cookies and similar technologies. What they are and how to control them is set out in our Cookie Policy.

11. Changes to this policy

We may update this policy as our practices or the law change. The date at the top of this page always shows the current version. Material changes will be flagged on the site before they take effect. Continuing to use the site after a change means you accept the updated policy.

12. Governing law

This policy is governed by the laws of the State of Florida, USA, without regard to its conflict of law rules.
